Terms of Service

Welcome to Beach Twins Swimwear. These Terms of Service (“Terms”) apply to your use of beachtwins.com (the “Site”) and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. “We,” “us,” and “our” refer to Beach Twins Swimwear.

PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT, AND WAIVES CLASS ACTIONS. YOU MAY OPT OUT AS DESCRIBED BELOW.

1. Using our Site
You must be at least the age of majority where you live, or have a parent or guardian’s permission, to place an order. You agree to give us accurate information when you shop, and not to use the Site for anything unlawful or to interfere with how it works.

2. Products and pricing
We do our best to show our products, colors, and sizes accurately, but colors can look different on different screens and we can’t guarantee every detail is exact. Prices are listed in U.S. dollars and may change at any time without notice. If a product is listed at an incorrect price or with incorrect information, we may cancel any orders placed for it and refund you in full.

3. Orders
Placing an order is an offer to buy. We may decline or cancel any order, including for suspected fraud, stock availability, or pricing errors. If we cancel an order you’ve paid for, we’ll refund you in full. Our products ship from partner warehouses, so an item may occasionally sell out after you order. If that happens, we’ll let you know and refund that item.

4. Payment
Payment is processed securely at checkout by Shopify and its payment partners. We never see or store your full card number. By placing an order, you confirm you’re authorized to use the payment method you provide.

5. Shipping
We ship to U.S. addresses only. Shipping costs, processing times, and delivery estimates are described in our Shipping Policy. Delivery times are estimates, not guarantees.

6. Returns and refunds
Our Refund Policy explains what to do if an item arrives damaged, defective, or isn’t what you ordered, and how refunds are issued.

7. Our content
All text, photos, graphics, logos, and other content on the Site belong to Beach Twins Swimwear or our suppliers and are protected by law. You may not copy, reuse, or sell them without our written permission.

8. Reviews and messages
If you send us comments, reviews, photos, or ideas, you allow us to use them to run and promote our store. Please don’t send anything unlawful, offensive, or that belongs to someone else.

9. Privacy and cookies
How we collect and use your information, including cookies, is explained in our Privacy Policy and Legal Notice.

10. Disclaimer
To the fullest extent allowed by law, the Site and our products are provided “as is” and “as available.” Except as stated in our Refund Policy, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or that the Site will always be available or error-free.

11. Limitation of liability
To the fullest extent allowed by law, Beach Twins Swimwear, its owner and its suppliers won’t be liable for any indirect, incidental, special or consequential damages, or for lost profits or lost data, arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

12. Your responsibility
You agree to cover any losses, costs or claims, including reasonable attorneys’ fees, that result from your misuse of the Site or your breach of these Terms.

13. Dispute resolution and arbitration
a. Contact us first. Before filing any claim, you agree to email support@beachtwins.com with your name, order number (if any), and a description of the problem and what you want. We’ll try to resolve it informally within 60 days. Neither party may start arbitration or a lawsuit until those 60 days have passed.

b. Binding arbitration. If we can’t resolve the dispute informally, you and Beach Twins Swimwear agree that any dispute, claim or controversy arising from or relating to these Terms, the Site, your orders or our products will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, instead of in court. The arbitrator’s decision is final and may be entered as a judgment in any court with jurisdiction. Payment of arbitration fees will follow the AAA Consumer Arbitration Rules.

c. Small claims. Either party may instead bring an individual claim in small claims court if it qualifies.

d. No class actions. You and Beach Twins Swimwear each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated or representative action. The arbitrator may not combine more than one person’s claims and may award relief only on an individual basis. You and we each waive the right to a trial by jury.

e. Opting out. You may opt out of this arbitration agreement by emailing support@beachtwins.com within 30 days of your first purchase, with your name, email address and the words “arbitration opt-out.” Opting out won’t affect any other part of these Terms.

f. Time limit. Any claim must be brought within one year after it arises, unless applicable law requires a longer period.

g. Severability. If the class-action waiver in section 13(d) is found unenforceable, then this entire section 13 will not apply. If any other part of this section is found unenforceable, the rest of it will still apply.

14. Governing law
These Terms are governed by the Federal Arbitration Act, the laws of the Commonwealth of Massachusetts, and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to section 13, any court proceedings will take place in the state or federal courts located in Massachusetts. Nothing in these Terms limits any rights you have that cannot be waived under applicable law.

15. Changes to these Terms
We may update these Terms from time to time. Changes take effect when they’re posted on this page, and the date at the top will show when they were last updated. Changes to section 13 won’t apply to disputes that arose before the change was posted.
