11. Resolving disputes

Contact us first. If you have a problem, email support@beachtwins.com and describe it. We'll try to resolve it informally within 60 days. You agree not to start any legal action until those 60 days have passed.

Binding arbitration. If we can't resolve it, any dispute arising from this website, your orders or our products will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either party may instead bring an individual claim in small claims court if it qualifies.

No class actions. You and Beach Twins Swimwear each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class, group or representative action. There is no judge or jury in arbitration.

Opting out. You may opt out of this arbitration agreement by emailing support@beachtwins.com within 30 days of your first purchase, with your name and the words "arbitration opt-out."

Time limit. Any claim must be brought within one year after it arises, unless the law requires a longer period.

12. Governing law

This notice is governed by the laws of the Commonwealth of Massachusetts and U.S. federal law, including the Federal Arbitration Act. Nothing in this notice limits any rights you have that cannot be waived under applicable law.
